These Terms & Conditions (“Terms”) form a binding agreement between Clanflare Solutions Private Limited (“Clanflare”, “we”, “our”, “us”) and you (the individual or entity that accesses or uses our website, software-as-a-service platforms, or managed services, collectively the “Services”).
By Browse our site, creating an account, purchasing a subscription, or otherwise using the Services you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
We may revise these Terms at any time. Updated versions become effective when posted; continued use of the Services after changes indicates acceptance.
1 Registration & Account Responsibility
- You must provide true, accurate, current, and complete information during sign-up and keep it up to date.
- All activity that occurs under your credentials is your responsibility. Notify us immediately of unauthorised use.
2 Pricing, Invoicing & Payment
- All prices are in Indian Rupees (INR) exclusive of taxes. We add GST at 18 % (or the rate in force).
- Accepted methods: UPI, credit/debit cards, net-banking, and other gateways we list. Orders are confirmed only after successful payment.
- By initiating a transaction you enter a legally binding contract with Clanflare for the chosen plan.
3 Delivery & Commencement
- SaaS credentials are provisioned within 24 hours of payment unless the plan description states otherwise.
- Managed-service projects begin on the mutually agreed start date.
4 Service Levels & Maintenance
- For Community OS Growth plan and above we guarantee ≥ 99.5 % monthly uptime, measured excluding:
- a) scheduled maintenance announced ≥ 48 hours in advance;
- b) force-majeure events (see § 11).
- We monitor core infrastructure 24 × 7 and strive to remedy critical incidents promptly.
5 Use Restrictions
- You will not use the Services or website for unlawful, harmful, or prohibited purposes.
- Unauthorised use (including penetration testing, scraping, or reselling without consent) may result in suspension and legal action.
6 Third-Party Links & Integrations
Our portals may contain links or connectors to third-party sites or APIs. Those properties operate under their own terms and privacy policies; we are not liable for their content or practices.
7 Intellectual Property
- All software, documentation, designs, trademarks, and content supplied by Clanflare remain our exclusive property.
- You receive a limited, non-transferable, revocable licence to use the Services during your active subscription solely for your internal business purposes.
8 Warranties & Disclaimers
- The Services are provided “as is” and “as available.” We do not warrant that they will meet your requirements, operate uninterrupted, or be error-free.
- Information on the website may contain inaccuracies; we disclaim liability for such inaccuracies to the fullest extent permitted by law. You must independently determine that the Services suit your needs.
9 Refunds
If we are unable to deliver the applicable Service, you may request a refund within the timeline specified in the relevant plan or policy. Requests made after that window are ineligible.
10 Limitation of Liability
To the maximum extent permitted by law, our cumulative liability for any claim arising out of these Terms will not exceed the fees you actually paid to us for the affected Service in the 12 months preceding the event giving rise to the claim. Under no circumstances are we liable for indirect, incidental, punitive, or consequential damages.
11 Force Majeure
Neither party is liable for failure to perform obligations if hindered by events beyond reasonable control (including acts of God, pandemic, war, governmental action, electricity or internet outages, or natural disasters).
12 Modifications to Services
We may enhance, modify, suspend, or discontinue any part of the Services upon reasonable notice (except in emergencies).
13 Governing Law & Jurisdiction
These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts located in Faridabad, Haryana.
14 Notices & Contact
All legal notices or questions about these Terms must be sent via the contact details published on our website. Notices are deemed received 24 hours after email dispatch or three business days after postal dispatch (registered mail).
